California Carpet Cleaning Law: AB 2801 and Your Rights
California updated its security-deposit rules with Assembly Bill 2801. As of January 1, 2025, a landlord can only charge a tenant for professional carpet cleaning when it's reasonably necessary to bring the carpet back to its move-in level of cleanliness — minus ordinary wear and tear. Automatic, blanket carpet-cleaning charges written into a lease are no longer allowed.
The law also draws a clearer line between normal wear and tear (not deductible) and tenant damage (deductible). Worn carpet in high-traffic lanes, light fading, and the gradual aging you'd expect from normal living are wear and tear. Large stains, pet damage, burns, and tears are damage a landlord can charge for.
AB 2801 added photo-documentation rules too. Starting April 1, 2025, landlords generally need photos of the unit after you move out and again after any cleaning or repairs to justify deductions, and for leases beginning on or after July 1, 2025, photos of the move-in condition as well. The practical takeaway for tenants: get the carpet professionally cleaned, keep your receipt, and take your own dated photos.
